COVID-19 drivers’ hours exemption extended to 31 May20 April 2020

In acknowledgment that the COVID-19 crisis looks likely to continue for at least another six weeks, DVSA has extended its relaxation of GB and EU drivers’ hours rules in England, Scotland and Wales.

This relaxation began on 23 March and was due to end on 21 April 2020. DVSA said the decision was made ‘on the basis of the current evidence.’

It points out that as the purpose of drivers’ hours rules is to reduce the risk of fatigue-related accidents, the relaxations should only be used where absolutely necessary; wherever possible, operators should recruit additional drivers.

The relaxations of the EU rules allow two more hours’ driving per day, two less hours of rest per day, or four more hours of driving a week or six per fortnight, among other changes.

The relaxations of the GB rules allow one more hour’s driving per day, one less hour of rest per day, to a maximum of five days working in seven. Full details are available via the link below.

An exemption on breaks will not be continued. That extended the duration of driving by one hour from 4.5 to 5.5 hours before a 45-minute break. That exemption ends on 21 April.

DVSA points out that when using a relaxation, drivers must note on the back of their tachograph charts or printouts the reasons why they are exceeding the normally permitted limits. “This is usual practice in emergencies and is, of course, essential for enforcement purposes.”
