Scottish operator has licence suspended for three months09 June 2017

A Kelso-based housebuilding firm has been suspending from using commercial vehicles for three months after its director made false declarations about the transport manager.

Joan Aitkin, Scotland’s traffic commissioner, also ordered that M&J Ballantyne’s licence will be cut from five to three vehicles when it is reinstated on 1 September.

The regulator said the O licence is not “a piece of paper – it is commitment to meeting responsibilities to keep people and property safe and for fair competition”.

Director Michael Ballantyne made a false representation to the traffic commissioner, in May 2012, when he confirmed in writing that Glynn Hobkirk was the transport manager – when Hobkirk had ceased to have active responsibility as transport manager seven years previously.

The regulator said individuals who falsely sign documents and give false undertakings to a public protection regulator undermine road safety and fair competition.
